What types of systemic litigation / legislative
advocacy work is possible?
ADA campaigns involving Title
II local and state government entities and / or Title III public accommodations.
Title II examples include: Reasonable
modifications of policies/practices involving state entitlement programs.
Accessible polling places/secret ballot issues, State Health and Human
Service Agency offices, universities, State Motor Vehicle offices, jails
and prisons, local and state courthouses, local and state parks and
wildlife areas, and state lottery programs.
Title III examples include: Medical
and dental offices, banks, restaurants, retail stores, convenience stores
and gas stations, hospitals and fitness centers.
ADA Title II Olmstead issues:
involving state schools, state hospitals, ICF-MR programs and nursing
homes.
Local or Statewide IDEA issues:
involving State Education Agency Monitoring practices; discipline issues
involving suspensions, expulsions, and placements in alternative education
programs (AEP); inclusion issues involving pre-school, elementary, middle
and secondary schools; extended year services; over-identification of
minority students in mental retardation and emotional disturbance categories;
transition services; Comprehensive System of Personnel Development (CSPD).
State Medicaid Program issues:
involving Home health services, durable medical equipment, nursing services,
and behavioral health services.
Federal Medicare Program issues:
involving Assistive Technology devices and Services.
